On January 1, 2002 the Employment Act, 2001 came into effect, establishing a new legislative regime governing relations between employer and employee. In some respects the new Act re-codified then-existing law but in others, for example as regards the unfair-dismissal and anti-discrimination provisions, the Act represented a departure from existing law by introducing concepts which, though known to English Law, were previously foreign to Bahamian employment law. Employing our expertise in this area of law we are fully able to assist clients, for instance employers, in dealing with work-place-related issues either pre-emptively (e.g. by ensuring that clear but lawful contractual regimes are in place) or shepherding clients through the litigative process from receipt of notice of a claim through to final disposition, judicial or negotiated. |
